Subject:EIV Notice H10-10 Posted TO HUDCLIPS
Housing Notice H10-10, Enterprise Income Verification (EIV) System, has been signed and posted to HUDCLIPS located: HUD Notice 10-10 .This Notice revises Housing’s previous EIV Notice H09-20. Subject:New Affirmative Fair Housing Marketing Plan (AFHMP) Form HUD-935.2A Effective May 1, 2010, a new version of the Affirmative Fair Housing Marketing Plan (AFHMP) Plan was implemented. When an owner/agent is required to submit a new AFHMP (once every 5 years), the new version of the AFHMP (form HUD-935.2A) must be submitted. The latest version of form HUD-935.2A is posted on HUDclips and can be downloaded at the following website: http://www.hud.gov/offices/adm/hudclips/forms/files/935-2a.pdf. Please be advised that the previous edition of form HUD-935 will no longer be accepted. Subject:Tenant Participation in MultiFamily Housing Projects On June 8, 2010, HUD posted a memorandum from Deputy Assistant Secretary Carol Galante regarding tenant participation in certain assisted and subsidized properties. The memorandum covers tenant’s right to organize, legitimate organizations, protected activities, and enforcement. Get the document here: Tenant particiaption in MultiFamily Housing Projects 24 CFR Part 245 Subject:Use of EIV Must be Resumed by Multifamily Program Users -RHIIP Listserv Announcement #227 Please be advised that Multifamily Program users must resume use of EIV in its entirety effective immediately. All Income Summary Reports are available to meet requirements for EIV use as defined by the Final Rule effective January 31, 2010. Subject:4350.1 Chapter 9 Revision HUD has revised Chapter 9 to the 4350.1. Click here to access the chapter: Monitoring of Civil Rights Requirements. Subject:EIV Still Unavailable - RHIIP Listserv #225 The link for the EIV system has been deactivated due to the inaccuracy of the displayed data. As indicated in Listserv Posting #224, please continue to perform third party verifications as done previous to the implementation of EIV. Continue to document the tenant files that have been affected by this outage. Contract Administrators are instructed not to issue MOR Findings due to an O/A not using EIV until such time when the system becomes fully functional. Subject:FY 2010 Income Limits posted HUD has released its FY2010 Median Family Income estimates and FY2010 Income Limits. Subject:HUD NYC Releases Bookletter #1 FY2010 - Utility Alllowances The NYC HUD office has released a bookletter describing an update to Utility Allowances. The Bookletter can be viewed here: Utility Allowances Bookletter Subject:New Instructions for OCAF worksheet HUD has released new instructions for completing the OCAF worksheet. The updates deal with rounding issues. The instructions can be viewed here: OCAF Instructions Subject:Final Rule Notice Posted to HUDCLIPS Housing Notice H10 – 08, Implementation of Refinement of Income and Rent Determination Requirements in Public and Assisted Housing Programs: Implementation of the Enterprise Income Verification System - Amendments; Final Rule, has been signed and posted to HUDCLIPS. This Notice is located at HUD Notice 10-08 Subject: Final Rule Webcast to be Held on April 14, 2010 The instructional webcast on the Refinement of Income and Rent Determination Requirements in Public and Assisted Housing Programs; Final Rule making the Enterprise Income Verification (EIV) system mandatory which was tentatively scheduled for March 31, 2010, has been postponed. The new date for this webcast is April 14, 2010, from 1:00 PM to 3:00 PM EST. The notice which provides guidance on this final rule is still in the clearance process thus causing the postponement. Subject: 2010 Annual Adjustment Factors The 2010 Annual Adjustment Factors (AAF’s) were posted in the Federal Register on Wednesday February 10, 2010. For all applicable rent adjustments requesting an AAF effective February 10, 2010 or after the new rates would apply. 2010 Area Definitions 2010 AAF Factors Subject: Enterprise Income Verification (EIV) Training The following training sessions and resources have been posted to the HUD web site. Subject: Enterprise Income Verification (EIV) & You Brochure - Requirements for Distribution and Use The following document was posted to HUD yesterday. it is highly suggested to read and adhere to the guidance within: (EIV) & You Brochure - Requirements for Distribution and Use O/As using the EIV system must provide each tenant household with the EIV & You brochure at the time of annual recertification along with a copy of the HUD Fact Sheet “How Your Rent is Determined”. O/As must also provide applicant households who have been selected from the waiting list for screening and final application processing with a copy of the EIV & You brochure. The brochure will be translated into thirteen languages for distribution to non-English speaking households. Subject: Refinement of Income and Rent Determination Requirements in Public and Assisted Housing Programs: Implementation of the Enterprise Income Verification System – Amendments; Final Rule The Amendments; Final Rule, was published in the Federal Register December 29, 2009. Subject: Notice 09-20: Enterprise Income Verification (EIV) System HUD published Notice 09-20 which provides detailed instructions for using the EIV system for upfront income verifciation. Use of EIV becomes mandatory on Janduary 31, 2010. It is highly advisable to dowload and reference this notice. Subject: 2010 OCAF Factors Released The 2010 OCAF factor has been published to the Federal Register. The OCAF Factor for NYS is 1.054. Subject: Contract Renewal Selection Guide for Owner's HTFC and CGI have developed a tool to assist owners through the Contract Renewal Option selection process. The Contract Renewal Selection Guide asks a series of questions to assist in determining an option for renewal along with information regarding submission requirements. Subject: HUD Handbook 4350.3 REV-1 Change 3 Announcement The effective date for implementation of Change 3 is August 1, 2009. The Change 3 to Handbook 4350.3 REV-1, Occupancy Requirements of Occupancy Requirements of Subsidized Multifamily Housing Programs, was issued on June 23, 2009. Many of these forms are produced from Software Vendors.. Subject: New Model Lease FAQ With the recent release of the new HUD model leases, HUD has released a questions and answers document for owner's. Please click on the following link to view the HUD Model Lease Question and Answers document. Subject: Economic Stimulus Payments (Tax Rebate) The Economic Stimulus payments (tax rebates) received by applicants applying for assisted housing and by tenants participating in HUD’s rental assistance programs are excluded from income for the purposes of determining eligibility and rent. The Economic Stimulus Act of 2008 requires this exclusion and the payments are an income exclusion under 24 CFR 5.609(c)(17) of HUD’s regulations. Subject: Is Fraud Worth It As a best practice, Tenant's should receive HUD Form 1141 - "Is Fraud Worth It" at the time of signing a lease as a reminder to report Fraud. To print out the HUD Form 1141 please select the following link: HUD Form 1141 - "Is Fraud Worth It" (English Format) HUD Form 1141 - "Is Fraud Worth IT" (Spanish Format) These forms along with many other frequently requested forms can be found by selecting "List of Frequently Requested Forms" from the "HUD and CGI Forms" drop down box located on the "Knowledge Center" page.
Subject: HAP Contract Renewals HUD has made a second major change to the HAP Contract that went into effect November 2007. HUD Counsel has determined that HUD must be a signatory to the HAP contracts processed by state PBCAs. Changes in the process will not impact owners. As before, CGI will send contracts to you for execution. When you sign and return, CGI and now HUD will sign and finalize the contracts and owners will receive a fully executed contract from CGI. Subject: Revised Family Model Lease HUD has released a revision to the Family Model Lease in the latest release of the HUD 4350.3 REV1, CHG 2 handbook. The revised Family Model Lease may be viewed by clicking the "Family Model Lease Appendix 4A" link below or by selecting "List of Frequently Requested Forms" from the "HUD And CGI Forms" drop down box located on the Knowledge Center webpage. ==> Family Model Lease Appendix 4-A In addition to the revised Family Model Lease, HUD has revised Appendix 4A pages 9 and 10. Owners/Management have 90 calendar days from the effective date, or September 24, 2007, to implement any software changes. All other changes are effective June 29, 2007.
